§ 1 General information
GTR Parts GbR sells and supplies exclusively only on following conditions. Verbal declarations / agreements are ineffective. Assertions as well as promises are obligatory only after written acknowledgement of the shop assistant. This applies also in the case of opposing purchasing conditions of the buyer. This set by the terms of delivery of the shop assistant out of strength the salesman detects such conditions not on, even if it contradicts them not expressly.
§ 2 Orders
Orders are on the salesmen only at the point in time of the service by mail obligatory. The date stamp of the distribution post office is not crucial. In the latter case the salesman is responsible to less or multi-supply not for wrongly -,; the risk from this order carries to full extent of the buyers. If the buyer requires not expressly an order confirmation, then the sent or enclosed calculation is considered at the same time as order confirmation. If accessories of any type are supplied or delivered falsely or not usable due to unclear specification of the orderer, then the orderer carries the entire risk. Claims for damages of any type are excluded to that extent.
§ 3 Supply and transport risk
All supplies are not-binding the salesman reserve themselves technical modifications as well as price adjustments. All supplies take place from stock of the shop assistant on danger of the buyer. As proof of the dispatch correct of the commodity - for the salesman - the collecting main of the receipt acknowledgement of the respective forwarding agent is sufficient. Damaged commodity may decrease the buyer to the transport enterprise only if by this enterprise the damage were logged and recognized. During neglect the buyer has to carry the damage developed from this. Feed-damaged commodity is not under any circumstances to the salesmen back sends to put but to the transport enterprise at the disposal. The salesman reserves himself a partial delivery, is presupposed that the partial delivery in detail can be used by the buyer. If ordered goods should not be removed, the salesman 30% of the gross of commodity value calculates resulted freight as representational allowance zzgl. -, packing and storage costs. An adhesion for the determination of the cheapest dispatch is not taken over by the shop assistant.
§ 4 Times for delivery
Ordered if commodity, which is available at stocks, by the shop assistant within shortest period one makes ready for dispatch. For orders, which do not belong to the constant stocks commodity, and which the salesman recalls directly with the manufacturer for the buyer, the salesman can dispatch only after delivery opportunities of the individual manufacturer. To the cancellation of contract because of disregard of the time for delivery the buyer is only then entitled if he set a written appropriate respite of at least 4 weeks to the shop assistant. Requirements on payment of damages because of late supply are impossible.
§ 5 Guarantee
The warranty of the salesman amounts to 6 months and is limited beyond that to the respective manufacturer data. From warranty promises of manufacturers no independent obligations can be deduced opposite the salesman. The guarantee is impossible under the following circumstances:
§ 5.1 With goods by other page or eliminated lack without agreement were changed, processed.
§ 5.2 With vehicles or sections, which are used in the competition.
§ 5.3 On competition sections there is no warranty.
§ 5.4 If the installation is made a framework place authorized by goods outside of.
§ 5.5 The warranty is limited to the pure section back-up.
Warranty claims are recognized only after immediate, written message with obvious lack within 7 days starting from receipt of the commodity. With entitled lack after selection of the shop assistant back-up is carried out. When failing the replacement or rework the right of the cancellation of the contract remains for the buyer. For this the commodity of the salesmen must be made available freely. Large requirements, in particular on payment of damages, are excluded impossible, resolution and rough negligence. All damages or damage are generally impossible by not appropiate or professional and appropriate handling, assembly, use or line-up of the sections supplied by us. For the investigation after § 29 StVZO (Tuev acceptance) of accessories of any type, necessary with use in the traffic, the salesman does not take over guarantee.
§ 6 Offers and sales
Offers or sales take place opposite commercial enterprises and last one the latter those the commodity in the sense of the BGB §14 in its independent vocational or commercial Activity in the sense of the HGB use. The use prospective customer assures with the registration, that all data given by it truely and completely.
§ 7 Duty to exercise diligence
The buyer has to carry for it providing to let all modifications and re-equipment at its vehicle, if it participates in public traffic, enter according to the legal regulations in his KfZ of papers (vehicle registration and banknote). The buyer must demonstrate the vehicle with technical control board (TUEV). The responsibility for the Tuev entry of converted vehicles or their sections is with the buyer.
§ 8 Retention of title
The supplied commodity remains property up to the complete payment of the shop assistant. Payments are to be made direct to the salesmen. The buyer may sell however regardless of the retention of title the goods in the course of business correct further, but without agreement of the shop assistant third neither pawn nor to protection convey. If the commodity before payment is further-sold, then proceeds obtained for it are to be surrendered easily to the salesmen. Proceeds are to be kept separately for the salesmen or to be only used for the cover their demand.
§ 9 Prices and terms of payment
The dispatch exclusively takes place against cash on delivery, financing, calculation, vorkasse or credit card! the salesman supplies always at that by day to the supply with valid prices. This applies in particular to jobs and orders during longer periods, even if the original order or order confirmation another price as the base were. The prices understand themselves excluding insurance, packing and forwarding expenses. All prices mentioned are in € excellently, terms of payment are cash, by euro cheque, credit card or financing.
The buyer pays/transfers, within 14 days the demanded invoice amount starting from invoice date.
§ 10 Place of delivery and area of jurisdiction
Place of delivery and area of jurisdiction for supplies and payments is the registered place of business of the shop assistant, thus D-67133 Maxdorf (Pfalz) Germany. It applies excluding German right.
§ 11 Validity
The conditions apply immediately. By the Escheinen of this catalog and/or the respective newest price list all past catalogs and/or price lists lose their validity. The nullity of the inefficacy of individual regulations does not touch the remaining regulations. Deviating declarations/agreements as well as warranties of all kinds require the writing of the salesmen reserve themselves construction and changes of size. For figures, drawings, sketches and other documents the salesman reserves himself property and copyrights.
§ 12 Other
Reproduction and copy, also in part, only with permission of the shop assistant. This does not take over adhesion for misprint.
All prices indicated in this catalog are in Euro exclusive tax.
